Reviewing IR35 Contracts   

Our comprehensive review package fully analyses both the contractual terms and working practices of the engagement(s) using our tried and tested IR35 status questionnaire. Upon completion, clients receive a comprehensive report, including a “pass” or “fail”.

The review provides a specialist opinion as to the IR35 status of engagement, and recommendations to improve the contractual terms, so contractors can decide how best to be remunerated.

The report is also evidence of undertaking due diligence, which those subsequently investigated can use to avoid a penalty; potentially up to 30% of the tax due.

Reports are ready within five working days, following receipt of the contract, completed questionnaire and payment of the review fee.

Our pricing structure is set out below. Where multiple contracts need reviewing, we can provide a bespoke quotation. For urgent cases, quotes can be provided to complete the report within the required timescale.

Drafting IR35 contracts

After discussing current or proposed working arrangements, our consultants can draft contracts to ensure they fall outside of IR35, whilst meeting the needs of the business. Having undertaken many successful defences against HMRC investigations, we are able to draft contracts with first-hand experience, and are prepared to ‘back up’ our drafting in Tribunals.

Defending HMRC enquiries

Markel Tax can advise those in an IR35 dispute with HMRC on appropriate tactics and technical arguments to defend their position. Alternatively, we can represent clients directly, corresponding with HMRC on their behalf. We have an unrivalled track record of success in this area with many IR35 disputes being conceded by HMRC.

With disputes handled on a fixed fee basis, there are no hidden costs or surprises. Cases can also be reviewed for a one-off fixed fee prior to full engagement. And where we are unable to resolve the dispute through technical correspondence, we can represent a client before the tax Tribunal.
